These Terms of Service ("Terms") govern your use of the services offered by Okairy Rodriguez ("Okairy," "we," "us") through the website at okairyrodriguez.com (the "Site"). The services offered are: Mentorship, Live Chart Reading, Recorded Astrology Reading, and Recorded Tarot Reading (each a "Service" and collectively the "Services").
By booking, paying for, or participating in any Service, you agree to be bound by these Terms, the Privacy Policy, the Disclaimer, and the Client Acknowledgment and Waiver. If you do not agree, do not book a Service.
Okairy Rodriguez is a Licensed Clinical Social Worker (LCSW), licensed in California (LCSW #62675) and Texas (LCSW #113455). She does not practice under her clinical license through this Site. The Services offered on this Site are non-clinical. The LCSW credential informs her depth, presence, and rigor as a coach and reader, but the Services are not clinical psychotherapy, are not subject to clinical confidentiality or recordkeeping standards, and are not a substitute for therapy with a licensed provider in your state.
If you are looking for clinical psychotherapy, contact a licensed provider in your jurisdiction. Resources for finding a licensed therapist include the Psychology Today directory (psychologytoday.com), your insurance provider's network, or your primary care physician.
Mentorship is a non-clinical, goal-oriented partnership in service of your awareness, thinking, and self-directed action. It is not psychotherapy, psychiatric treatment, or clinical care. It does not diagnose, treat, or address mental health conditions or psychiatric symptoms.
Coaching is a process, not a single conversation. While clients may notice change quickly, refining and sustaining change typically takes several months. Clients are encouraged to consider an engagement of at least three months, although this is not contractually required.
The coaching commitment is to honor the time of each session, hold what is shared in confidence (subject to law), hold no judgment, respect your view of your own life, and concentrate on what is working and how to build more of it. The work proceeds from the assumption that you already hold your own answers; the coach's role is to bring awareness, clarity, and, where you choose, action.
If during a session it becomes clear that clinical care is needed, Okairy will recommend referral to a licensed clinical provider in your jurisdiction.
Live Chart Reading is a 60-minute one-on-one video session that uses astrological symbolism to support reflection and self-understanding. It is offered for educational, reflective, and entertainment purposes. It is not predictive of specific future events, financial outcomes, medical outcomes, relationship outcomes, or any other outcome. It is not a substitute for therapy, medical care, legal advice, or financial advice.
Recorded readings are delivered to you as a video or audio recording, typically within five (5) business days of completed payment and intake. These readings use astrological or tarot symbolism for educational, reflective, and entertainment purposes. They are not predictive of specific future events and are not a substitute for therapy, medical care, legal advice, or financial advice.
Once a recorded reading has been delivered to your email or made available via private link, the Service is considered complete and refunds are not available (see Section 9).
All Services are limited to adults 18 years of age or older. By booking, you confirm that you are 18 or older, have the legal capacity to enter into this agreement, and the information you provide during booking and intake is accurate to the best of your knowledge. Services are not provided to minors.
Service fees are charged in U.S. dollars at the time of booking through Stripe. Current pricing is displayed on the Services page. Your time slot, where applicable, is reserved upon completed payment. Pricing may change with notice; the price quoted at booking is the price you are charged.
Okairy is not an in-network provider with any insurance carrier and does not bill insurance. Because the Services on this Site are non-clinical, they are generally not eligible for insurance reimbursement, FSA, or HSA coverage. You are responsible for any tax or other obligations on your end.
Live sessions (Mentorship, Live Chart Reading) are conducted by video conference via Zoom or an equivalent platform. By booking a live session, you consent to video delivery and acknowledge the following:
Full refunds are available within 24 hours of payment, provided no session has yet been delivered. After 24 hours, no cash refunds are issued. The service value is held as credit toward a future session for 90 days from the original payment date. Credit not used within 90 days is forfeited.
Refunds are available within 24 hours of payment, only if the recorded reading has not yet been delivered. Once the recording is delivered, the Service is complete and no refund is available.
Documented medical or family emergencies, military deployment, or natural disaster may be considered for refund or extended credit beyond the standard policy, at Okairy's discretion.
To request a refund or apply credit, email hello@okairyrodriguez.com with your booking confirmation and the reason for the request.
Live sessions must be scheduled within 14 days of payment, with a minimum of 3 days lead time from the booking date. Rescheduling is permitted with at least 24 hours notice. Less than 24 hours notice is treated as a missed session and applied against the 90-day credit window. Missed sessions without notice are not refunded and are not eligible for rescheduling.
If you are more than 10 minutes late to a scheduled session without prior notice, the session is treated as canceled and the session value is forfeited. Sessions begin and end at the scheduled time. If Okairy is more than 10 minutes late or fails to appear without notice, you may reschedule the session at no additional charge or receive a full refund of that session's fee.
Live sessions are not recorded by default. Recording requires mutual written agreement before the session begins. You may decline recording at any time. If a session is recorded, the recording is stored privately, is not shared with any third party, and is deleted on your written request.
For Recorded Astrology and Tarot services, the recording is the deliverable and is created specifically for you. See Section 12 for ownership and use.
You may not record any live session without Okairy's prior written consent. Unauthorized recording may result in immediate termination of the Service without refund and may violate applicable law.
All content on the Site, including text, graphics, design, and underlying code, is the property of Okairy Rodriguez or her licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, modify, distribute, publish, or create derivative works from Site content without prior written permission.
Recorded Astrology Readings and Recorded Tarot Readings are licensed to you for personal use only. You may keep and revisit your recording for your own reflection. You may not publish, broadcast, post publicly, resell, redistribute, or use the recording for any commercial purpose. You may not share the private delivery link with third parties.
Notes, exercises, frameworks, or written material Okairy may share with you during or after a session are licensed for your personal use. They may not be redistributed or used commercially.
Information you share is kept private as described in the Privacy Policy. Because the Services are non-clinical, the heightened confidentiality and recordkeeping standards that apply to clinical psychotherapy do not apply here. Confidentiality is professional and ethical, with disclosure only where required by law or where there is a credible threat of harm to yourself or others.
Consistent with professional norms, Okairy generally does not accept friend, follow, or connection requests from current or former clients on personal social media accounts. This is to protect the integrity and clarity of the coaching relationship.
You are welcome to follow Okairy's professional accounts where they exist. Following a professional account does not create a coaching relationship and is not a substitute for a session.
Between sessions, brief logistical communication (scheduling, rescheduling, billing) by email is appropriate. Email is not a secure channel and should not be used for substantive coaching content or sensitive personal disclosure. For substantive content, use the next scheduled session.
Okairy will not enter dual or multiple relationships with clients that could impair professional judgment or create risk of harm. This includes refraining from social, business, financial, or romantic relationships with current clients.
No Service predicts your future, diagnoses any condition, or guarantees any outcome. Astrology and tarot are symbolic reflective tools, not predictions. Coaching supports your own self-directed action; outcomes depend on the decisions you make and many factors outside the session. The application of any session content to your life is your own decision.
Either you or Okairy may end the working relationship at any time. Okairy may decline to continue or refuse future bookings in cases of harassment, threats, abusive conduct, repeated missed sessions, non-payment, or behavior that puts the safety or integrity of the practice at risk. Termination for these reasons is at Okairy's sole discretion and does not require refund beyond the standard policy in Section 9.
The Site may contain links to third-party websites or reference third-party resources. Such links and references are provided for convenience. Okairy does not control, endorse, or assume responsibility for the content, privacy practices, or operation of any third-party site or service. Use of any third-party site is at your own risk and subject to that site's own terms and policies.
To the maximum extent permitted by law, Okairy Rodriguez and any associated business entity are not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profit, loss of data, personal injury, or property damage, arising out of or related to any Service, your access to or use of the Site, or any content delivered through the Site. This limitation applies regardless of the theory of liability (contract, tort, statute, or otherwise) and applies even if Okairy has been advised of the possibility of such damages.
Where applicable law sets a maximum that cannot be excluded, liability is limited to the lesser of that maximum or the total fees you paid for the specific Service giving rise to the claim in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless Okairy Rodriguez and any associated business entity from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of any Service, your unauthorized use or distribution of recorded content, or your provision of inaccurate intake information.
These Terms are governed by and construed in accordance with the laws of the state of Texas, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or any Service shall be subject to the exclusive jurisdiction of the state and federal courts located in [COUNTY], Texas. You consent to personal jurisdiction and venue in those courts and waive any objection based on inconvenient forum.
Before initiating any formal legal action, you agree to first attempt to resolve the dispute by sending a written description of the issue to hello@okairyrodriguez.com and allowing Okairy thirty (30) days to respond and attempt resolution in good faith.
If the dispute is not resolved within that period, either party may pursue available remedies through the courts identified in Section 21.
Neither party is liable for any failure or delay in performance to the extent caused by circumstances beyond reasonable control, including acts of God, natural disaster, fire, flood, pandemic, public health emergency, war, civil unrest, government order, internet or platform outage, or telecommunications failure.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
These Terms, together with the Privacy Policy, the Disclaimer, and the Client Acknowledgment and Waiver, constitute the entire agreement between you and Okairy regarding your use of the Services and supersede any prior or contemporaneous agreement, written or oral.
You may not assign or transfer your rights or obligations under these Terms without prior written consent. Okairy may assign rights and obligations in connection with a sale, merger, or transfer of the practice.
These Terms may be updated from time to time. The date at the top reflects the most recent revision. Continued booking or use of the Services following an update constitutes acceptance of the revised Terms.
